The Notorious Network

1. Eligibility

To participate, you must:

• Be 21 years of age or older
• Reside in the United States
• Be legally permitted to promote tobacco products in your jurisdiction
• Maintain a public social media presence with at least 5,000 followers
• Have an account in good standing on Instagram, TikTok, YouTube, or other approved platforms

2. Commission & Payment

• You earn 15% commission on net sales through your personal referral link or discount code
• High-performing affiliates may be elevated to 20% commission
• Net sales exclude shipping, taxes, discounts, refunds, or chargebacks
• Payouts are made monthly, typically by the 15th, via PayPal, bank transfer, or other approved method
• A minimum payout threshold of $50 may apply

3. Brand & Content Guidelines

You agree to:

• Promote only to audiences aged 21+
• Maintain alignment with the brand tone — premium, confident, elevated
• Avoid misleading claims or unauthorized promotions
• Refrain from posting or associating with content that promotes violence, hate, illegal activity, sexually explicit material, or excessive profanity
• Avoid partnerships with competing cigar or tobacco brands while active in the program

4. Paid Advertising Restrictions

To protect the brand’s identity, you may not run paid ads (e.g., Google Ads, Meta Ads) using the Notorious Cigars name, logos, trademarks, or branded search terms without prior written permission.

5. Disclosure Requirements (FTC Compliance)

You are legally required to follow FTC guidelines for affiliate marketing. You must clearly disclose your relationship with Notorious Cigars in all posts, videos, and content where a link or code is used. Use straightforward, visible language such as:

• Do not hide disclosures in hashtags or fine print
• In video or audio content, make a verbal or visible disclosure early in the content

6. Welcome Package & Materials

Once accepted, you may receive:

• Branded Notorious Cigars t-shirt and hat
• Lighter and cutter
• Two boxes of Notorious Cigars
• Your personal affiliate link and discount code

These materials are provided to support your content and must be used responsibly.

7. Use of Content

By participating, you grant Notorious Cigars the right to repost or feature your content across digital channels, email, or advertising, and use your content in campaigns, paid media, or packaging (without further approval or compensation). You retain ownership of your content, but grant the company a non-exclusive, royalty-free, perpetual license to use it.

8. Program Discretion & Removal

Participation is by invitation only. We reserve the right to remove or suspend any participant at any time for any reason. Grounds for removal include:

• Violating these terms
• Promoting competitors
• Off-brand conduct
• Misuse of promotional tools

Unpaid commissions will be paid on the next scheduled payout.

9. Taxes & Reporting

If you earn $600+ in a calendar year, we may request a Form W-9 and issue a 1099-NEC for tax reporting. You are responsible for reporting and paying your own taxes.

10. Changes to the Program

Notorious Cigars reserves the right to update, modify, or discontinue the program or these terms at any time. All updates will be posted on our website or sent via email.

11. Agreement & Consent

By applying to and participating in The Notorious Network, you confirm that:

• You meet the eligibility requirements
• You agree to all terms in this document
• You will represent Notorious Cigars professionally and in full compliance with U.S. law

12. Code of Conduct

As a representative of Notorious Cigars, you agree to:

• Uphold the values of confidence, loyalty, and professionalism
• Avoid content or conduct that promotes violence, hate, discrimination, or illegal activity
• Refrain from inflammatory political or religious commentary while representing the brand
• Maintain respectful communication with the company, its team, and fellow ambassadors
• Notify Notorious Cigars of any incident that could impact the brand or your public image

Violation of this code may result in immediate removal from the program.
